Contentious Probate is in basic terms, a disagreement after someone has passed away about the distribution of their estate. Contentious Probate is a term that can be used interchangeably with will disputes. It also covers disputes where there is no will.
This can include challenging the validity of a will, making an Inheritance Act claim, or it could be a dispute about whether the Personal Representative is administering the Estate properly.
Even if the will is not disputed you may be concerned that the Personal Representative is not administering the Estate properly. We can advise you whether the administration is being handled correctly and, if not, we can take steps to resolve matters, including liaising directly with the Personal Representative or applying to the Court for a Court order ensuring that the Estate is administered properly and in some cases for the replacement of the Personal Representative.
